Hospital consultant Essam Aly has been required to hand over all his assets including property and savings worth over £500,000 to his ex-wife, who he left to move abroad, a report from the Telegraph revealed.
Aly left his wife Enas four years ago in 2011 before moving to Bahrain and has not paid any amount towards maintenance or child support since 2012.
Concerns were that the ‘serial defaulter’ doctor would not contribute payments ever again as support for his ex-wife and their two children.
A family court judge gave the order that all of the Aly family’s fortune should go to Mrs Aly, 46. Court of appeal judges held the pay-out and Essam Aly’s lawyer described it as “an extraordinary departure from equality”.
Mr Aly, 54, was said to have shown himself to be “unwilling” to provide any support, according to Lady Justice Macur.
Slater and Gordon solicitor Andrew Newbury, an expert in family law, said it was “exceptional but not unique” for one party in a divorce case to receive 100 per cent of the assets.
Last year at the Birmingham Family Court, Mrs Aly made a complaint that she received nothing from her husband since his departure. In July 2014, Judge Mark Rogers awarded her the proceeds of sale of their £250,000 home in Burton, as well as another £310,000 held in the bank.
Appeal judge Lord Justice McFarlane stated her case was that Aly had effectively “abdicated responsibility” for her and his children.
