
Burke Niazi’s Community Care department works hard to ensure that clients receive the support, care and treatment from Social Services and the NHS to which they are entitled.
Our clients may need care services because of their physical or mental disabilities and health conditions. Many of our clients have severe and enduring mental health difficulties, including learning disabilities, and need support to live more independent and fulfilling lives. Other clients are elderly or have complex physical health problems and need specialist care in their own home or residential care. We also act on behalf of children, carers and people whose immigration status prevents them accessing the care they need, such as failed asylum-seekers.
We challenge failures by social services and health authorities to properly assess and provide for our clients’ needs. We also challenge withdrawals of services and changes to care packages.
We often advise and assist clients with charging disputes, for example, when residential care should be fully funded by the NHS as Continuing Healthcare or as an aftercare service under the Mental Health Act 1983.
We always try to resolve cases quickly by dealing with the social services and health authorities involved, but when necessary, we pursue our client’s cases in the Courts, by bringing High Court claims in judicial review or seeking other legal remedies.
Most of our clients are eligible for public funding from the Legal Services Commission under the Legal Help scheme or a Legal Aid certificate. For clients whose health or disabilities prevent them from travelling to our offices, we carry out home visits.
